These Terms & Conditions (“Terms”) govern your access to and use of the PropCheck SaaS platform and services (“Service”), operated by PropCheck (“we”, “us”, or “our”). By accessing the Service or creating an account, you agree to be bound by these Terms.

1. Description of the Service

PropCheck provides automated digital analysis tools for property investors, available via:

Subscriptions: Recurring monthly or annual access to platform features.
Reports Packages: One-time purchase of reports used to trigger automated analyses.
Nature of Service: All reports are generated automatically by software and intended as decision-support signals only. We do not provide manual consulting, legal advice, or guarantees of financial performance.

2. User Accounts and Authentication

‍Account Requirement: To purchase and use the Service, you must create a user account.
‍Authentication: You may register via email or Google OAuth. You are responsible for maintaining the security of your credentials.
‍Authorized Use: You may only submit URLs or data for analysis that you own or have explicit authority to analyze.

3. Payment Terms & Billing

Merchant of Record: All payments are processed by PayPro Global, our Merchant of Record. PayPro Global is responsible for billing, recurring charges, and global tax compliance (including US Sales Tax).
Subscriptions: Monthly and Annual plans renew automatically unless cancelled via your dashboard before the next billing cycle.
‍Reports: Reports are added to your account upon successful payment and consumed immediately upon initiation of an analysis.

4. Reports Usage & 30-Day Retention Policy

Reports Consumption: One (1) report is considered "used" the moment an automated analysis is initiated. Once consumed, the action cannot be undone.
Data Retention: To ensure system performance, all analysis results and reports are stored for 30 days. After this period, results are permanently deleted without further notice. It is the User's sole responsibility to save reports within this timeframe.

5. Refund Policy

DUE TO THE DIGITAL NATURE OF THE SERVICE AND THE IMMEDIATE ALLOCATION OF COMPUTATIONAL RESOURCES, WE MAINTAIN A STRICT REFUND POLICY:

Report Packages: No refunds will be issued for used reports. You may request a refund for an entirely unused report package within 14 days of purchase, provided that zero (0) reports have been spent.
Subscriptions: You may cancel at any time. Access remains active until the end of the current billing period. We do not provide prorated refunds for unused time.
Technical Failure: If a verifiable technical error prevents delivery, we will provide a replacement report. Further remedies are at our sole discretion.

6. Disclaimer of Warranties & No Advice

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE".

Not Professional Advice: The Service, including "Scenario Summary", is for informational purposes only. We are not real estate brokers, financial advisors, or legal professionals.
No Guarantees: We do not guarantee the accuracy of the automated analysis or any specific financial outcome from using the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROPCHECK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR USE). OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

8. Governing Law & Dispute Resolution (Arbitration)

Governing Law: These Terms shall be governed by the laws of the State of Wyoming, USA.
Binding Arbitration: Any dispute arising out of these Terms shall be resolved through binding arbitration in Cheyenne, Wyoming, or a mutually agreed location.
Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
